Bitcoin Rush

Bitcoin Rush is a boiler room scam designed to defraud people out of their savings by using the idea of an AI robot that can trade cryptocurrency for you without risk, overcoming the need to know about trading or to have any luck or money to invest upfront. In reality these people will just take your money away using a series of scams relating to overseas CFD brokers.

 

Bitcoin Rush is now at the domain name Bitcoin-Rush.org which is presumably because they give their software and the profits it generates away for free. FREE MONEY ALERT!

In reality of course, no private enterprise should be using a .org domain, they are specifically set aside for non-profit organisations, but his idea was never enforced. It is not like owning a .IT domain where you have to prove that you live in Italy. With a .org domain you can buy it online without any obligation to prove you are a non-profit organisation in any way.

Let's have a look at this website and see if we can understand what they are trying to achieve with this .org domain:

Well firstly, let's have a look at the top of the site, as that is where we would normally arrive at BitcoinRush.org.

There is not really information on what they are or what they do, just a series of commands - Sign-up, Create and Account and then there is a registration form, but nowhere has anyone explained what we are signing up for!

Well there are some terms and conditions at eth bottom of the form that we are agreeing to, so let's have a look at those first, the privacy policy can wait.

Rather strangely, the T&Cs are displayed here: https://sol-e.alwayssunny.care/terms/tandcs.html which is an odd domain name indeed. AlwaysSunny.care is registered with Cloudflare and has no real details as to who owns or maintains it online.

Terms and Conditions

Provider (the “Company“, “us“, “our” or “we“) provides vicariously through its designated software and website (the “Website“) certain marketing, advertising, promotion and related services (the “Service“; the Service users shall be referred to as the “Users“, “you“ or “your“). These Terms of Use (the “Terms“) govern the Users access and use of the Website and Services. Users must agree to these Terms prior to using the Website.

Please read these Terms carefully. These Terms govern your access to and use of the Website and Services. By accessing, registering to use, downloading, sharing or otherwise using the Website or using any software scripts provided by us in order to make the Website available or usable, you signify your assent to both these Terms and our Privacy Policy, and which may be modified or otherwise changed from time to time at our sole discretion. Your continued use of the Website will be deemed acceptance to any such amended or updated terms. If you do not agree to any of these Terms, please do not click “ACCEPT” and do not use the Website.

This is an interesting opening couple of paragraphs. These T&Cs appear on a completely different domain name but make no mention of which website "The Website" refers to. They also describe "The service" as a marketing, advertising and promotional service, which must mean that the whole of this is an advert rather than a product. This is important to note, here it is in black and white, Bitcoin Rush is not real! The Bitcoin Rush software is just a website! 

Let's move on to point one:

1. Use of Website and Services

Subject to the terms and conditions set forth herein, you may access and use the Website for the purpose of using the Services on a non-exclusive basis. You acknowledge that the Company may, in its sole discretion and at any time, modify, update or otherwise change the Website or Services, including discontinuing providing any part or all of the Website and/or Services or modify or delete any content available through the Website or Services, without prior notice.

So, remembering that their use of the word software actually just means website we can start to see that this whole domain is just promotional material for another type of business altogether. This is just a puff piece to get you all psyched up to buy something else. Something that you probably don't want to buy. In other words they are hiding behind the idea of promotion and advertising to sign you up to something that may well cost you a lot of money. In other words, they are trying to 'sign you up' (forward your details) to a scammer, a boiler room scammer to be precise.

Moving on:

Use of the Website and Services is void where prohibited. By using the Website and Services you represent and warrant that: (a) any information you submit (if applicable) is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are at least the age of majority in your jurisdiction; and (d) your use of the Website or Services does not violate or promote the violation of any applicable law or regulation or any legal or contractual obligation you may have to a third party and you have and will at all times comply with all applicable laws, rules and regulations in connection with your use of the Services and Website, any services arranged through the Services and Website, including without limitation such services connected in any way to the Products or Third Parties, as such terms are defined herein.

So they are insisting on truthful and accurate information when everything they have said in their T&Cs so far explains that they are disingenuous, treacherous and are inventing a product to use as an advert. 

Subsections (a)-(d) shall be referred to, jointly, as the “Users Undertakings and Warranties“.

By using the Services or Website you understand and agree that the Company may in its sole discretion, but is not required to, verify that any or all of the Users Undertakings and Warranties are met by any User and you further agree that the Company is not responsible for assuring that the Users Undertakings and Warranties are met or for any failure to suspend, terminate or prevent the use of the Services or Website by Users who do not meet the Users Undertakings and Warranties. You understand that you are solely responsible for making your own evaluations, decisions and assessments about whether to engage with any Third Parties or otherwise interact with any Third Parties in any way. If you become aware of any violation to the Users Undertakings and Warranties you are encouraged to report it to the Company.

So what they are stating in this section is that they are under no obligation to be sure you are legally entitled to use any of the services that you may receive in your territory and under the local laws in place there. This essentially means that if you are under age or in a territory where services you find your self using (such as CFD trading, which are illegal in Israel, Canada and the US) they take no responsibility whatsoever for your usage of said products. The use of their website by you is entirely at your own risk and you are responsible for making sure you are legally entitled to use those services in your location.

The Company reserves the right not to provide you with any Services with or without notice in its sole discretion, whether it becomes aware of any violation to the Users Undertakings and Warranties (either by reports provided to it by other Users or any other means) by you or any other User, or for any other reason. Without derogating from the above, the Company expressly disclaims, and you expressly release the Company from, any and all liability whatsoever for any controversies, claims, suits, injuries, loss, harm and/or damages arising from and/or in any way related to: (i) any inaccuracy, untimeliness or incompleteness of a User’s or Third Party’s representations; and (ii) misstatements and/or misrepresentations made, either in connection with or by any of the Third Parties or other Users, Products or otherwise. So once again they are stating in black and white that they are just an advert and are in no way liable for the services that they are directing you to (under false pretences) as those sites and services are run by a third party over which they claim no responsibility.

They still do not specify this website but that will be because they use these terms and conditions for all of the boiler room scams in which they are involved and they don't want to have to pay a lawyer more than once.

Moving along, we can see how ridiculous these terms are:

You understand and agree that the Company: (a) does not employ, recommend or endorse any Third Parties or Products, as relevant, or any related party thereof, and has no control over the acts or omissions of any Third Party, their business, their products or services; (b) makes no representations or warranties about the Third Parties and Products, including their quality, pricing, compatibility, availability or any other features, or about your interactions or dealings with any Third Parties; (c) makes no representations or warranties about the proprietary rights or other rights or features or regulatory aspects related to the Products, including any required authorization, permits or licenses for the upload, sharing or otherwise making available, and for the use, sale and purchase of such Products; and (d) is not responsible for the performance or conduct of any User or other third parties in any way using or having used the Services, and/or on or off the Website. The Company is not obligated to screen or otherwise to verify any information regarding Third Parties and/or Users, the Products or any other feature related to the Website or Services and therefore, you should exercise caution and perform your own examinations and checks before engaging with anyone through the Services or Website or otherwise interacting with anyone.

They are distancing themselves from the very act they are performing. They are using misinformation to recommend a website that they know to be fraudulent and yet are denying any responsibility for their conduct. They are putting forward a claim that they are not obligated to check the third parties they are advertising in anyway, which is totally incompatible with advertising within the UK.

The Company expressly disclaims, and you expressly release the Company from, any and all liability whatsoever for any controversies, claims, suits, injuries, loss, harm and/or damages arising from and/or in any way related to the Third Parties, Products, Services and Website or your interactions or dealings with any Third Parties, including without limitation any acts and/or omissions of Third Parties in any way using or connected to the Services or Website in any means. By using the Services or Website, you acknowledge that you are solely responsible for such use and the connections, interactions, purchases or any other action you make and that all use of the Services or Website is at your sole risk.
